The preliminary inquiry into the Good Friday murder at Laing Avenue recently took a dramatic turn. During a hearing, the main witness, who is said to be the dead man’s daughter, indicated to the court that she did not wish to offer any evidence against the accused, Aman Lalchan.
On March 21last, George Barton, 48, of 34 Howes Street, Charlestown, was shot dead, reportedly by gunmen in a white car. Lalchan was subsequently arrested and charged for the murder.
When Lalchan’s lawyer, Basil Williams, announced that the witness was declining to testify, this sparked much surprise in the court.
Williams told the court that he was advised by the Director of Public Prosecutions that Barton’s daughter did not want to offer any evidence. However, this was met by much opposition from the prosecution.
Williams had sought permission from the court to have the witness enter the witness box and inform the court that she no longer wanted to give evidence.
However, the police prosecutor informed the court that they would vigorously continue the matter, since they were not informed by the Director of Public Prosecutions that the witness no longer wanted to go ahead.
Williams further told the court that the witness reportedly visited the Director of Public Prosecutions and was made to sign a document stating her position on the case.
The lawyer then mentioned to the court the imminent passage of the Plea Bargain Bill, which is expected to be tabled in Parliament later this week. This bill is expected to provide for persons who would not want to take the witness stand to offer recorded evidence.
