Oliver Hinckson, who is charged with advocating a terrorist act, possession of arms and ammunition, and sedition, made yet another appearance yesterday before Acting Chief Magistrate Melissa Robertson-Ogle.
Before the hearing commenced, defense counsel Mark Waldron asked the Magistrate to have the handcuff and shackles removed from Hinckson who was taken into court in that manner.
The Magistrate then ordered the police to unshackle Hinckson.
Soon after, Special Prosecutor Sanjiv Datadin who has been assigned to prosecute the sedition and terrorist charges once again raised the issue of Magistrate Gordon Gilhuys’s absence.
Datadin indicated to the Magistrate that the court is now left with three options: to wait on Gilhuys, commence trial before Her Worship or reassign the case to another Magistrate who will deal with the case expeditiously.
Datadin, who was absent on the first occasion when the case was first called before the Acting Chief Magistrate, said that he was made to understand that the defense had objected to the case being presided over by another Magistrate.
At that point Magistrate Robertson-Ogle interjected, noting that the defense had agreed to have the case heard in her court.
The issue of the delay in the trail was raised by Waldron, who noted that since the Acting Chief Magistrate will soon be proceeding on annual leave, it would mean that the matter would be put down for one month.
“When Your Worship goes on leave we will be in the same predicament…the administration has the responsibility to allow Mr. Hinckson to have a fair and speedy trial and he (Hinckson) should not be made to suffer,” Waldron told the court.
Having said that, both the defense and the prosecution agreed that they were ready to go ahead with the Preliminary Inquiry into the sedition charge, as the arms and ammunition case has been put off until September 3.
The first witness, Detective Sergeant Trevor Reid, took to the stand to give evidence.
Reid will be crossed examined by the defense team come September 3 when the matter will be called again.
