A Brazilian national was on Tuesday remanded to prison after being charged with being in possession of illegal firearm and ammunition, when he appeared in the Georgetown Magistrates’ Courts.
Sebastiad DeOliveria Moura is alleged to have had a 9mm pistol along with 12 live rounds of matching ammunition when he was not the holder of a firearm licence on March 19, at Eyelash Backdam, Port Kaituma, North West District.
Moura pleaded not guilty to the allegation read to him with the aid of a Spanish interpreter. His Attorney, Latchmie Rahamat, made an application for her client to be released on reasonable bail. Rahamat told the court that her client has been operating a $20M business (a shop) located in Port Kaituma, Water Front for the past six years.
The lawyer told the court that on the day in question, police ranks went to her client’s shop and conducted a search. Rahamat stated that the gun along with ammunition was found on a counter top in the shop and not in Moura’s possession.
Rahamat added that her client explained to the ranks that multiple persons have access to the shop since he employs shopkeepers. She contested that at the time of his arrest, her client was not provided with a translator and was unaware of what was taking place.
However, the application was met with objections by Police Prosecutor, Inspector Neville Jeffers. He argued that the defendant has no ties to Guyana and is a possible flight risk. Jeffers also pointed out the seriousness of the offence.
Inspector Jeffers told the court that the defendant speaks fluent English and even admitted to police that the illegal items belonged to him.
Chief Magistrate Ann McLennan upheld the objections put forward by the Prosecutor and remanded Moura to prison until May 2.
This matter was transferred to the Matthews Ridge Magistrate’s Court.
