A High Court injunction has been granted against a religious organisation, restraining those involved in the functions of the group from making loud noises during spiritual gatherings.
According to the application presented to Justice James Bovell-Drakes at the Georgetown Supreme Court, a centre within the International Society for Krishna Consciousness Limited is being sued by private citizen Bholanauth for noise nuisance.
Bholanauth and Fawzia Saheed have been named as plaintiffs in the matter.
According to documents filed by Attorney Saphier Husain on behalf of the plaintiffs, the centre, located at Parcel, Block CXVII, Zone, Cummings Lodge, East Coast Demerara (ECD), also known as Lot 1 First Street, Cummings Lodge, ECD, is being sued for damages, in excess of $100,000 for pecuniary losses, personal injury, annoyance, interference with sleep and communication and likely hearing loss caused by excessive noise from religious chanting, use of loud speakers and musical instruments and prayers in the organisation.
The defendants are also being sued for damages in excess of $100,000 for breach of covenant of title by noise nuisance and establishment of religious organisation and for in excess of $100,000 for breach of covenant of title by noise nuisance and establishment of religious organization, constructing a building above the usual height of residence and causing interference with the air space of the Plaintiff.
The injunction granted by the High Court on July 22, 2015 outlined that the centre within International Society for Krishna Consciousness Limited has been restrained “either themselves, their servants and/or agents and each and every one of them, from continuing to make loud noise by religious chanting, use of loud speakers and musical instruments and prayers to the annoyance and personal injury of the plaintiff.”
The order further outlined that if parties within the International Society for Krishna Consciousness Limited “neglect to obey this Order/Injunction by the time therein limited (forthwith), you will be liable to process of Execution/Contempt of Court for the process of compelling you to obey the same judgement/Order/ Injunction”.
The matter is set for continuation on September 8, 2015.
