The father and son who have so far undergone two High Court trials, both of which ended in hung juries, have been granted bail in the High Court.
The duo Roy Pestano, 61, and his son Raymond Pestano, 37, of Number 41 Village West Coast Berbice are accused of murdering fellow villager Davanand Ramlagan, 25, on October 19, 2002.
They were granted their latest reprieve when their most recent High Court trial ended in a hung jury before Justice Navindra Singh and a mixed Jury in the Berbice High Court.
The incident is alleged to have been committed at the Breezy Point shop, Number 41 Village, West Coast Berbice.
At the completion of the hearing, Justice Singh had told the two defendants that they will have to be remanded to prison and face a judge and jury again at the next sitting of the Berbice Criminal Court. Roy Pestano had blurted out in court, “I hope it gon be early this time.” Justice Singh had told him he will have to take his concerns to the DPP.
The men, through their attorney Peter Hugh, petitioned for bail which was granted in the sum of $450,000 each by Chief Justice Ian Chang.
Prosecutor Renita Singh in her opening address had recounted the October 19, 2002, incident in which she stated that at around 21.30 pm, the deceased Kenrick Ramlagan and his cousin Goel Ross were at the Breezy Point shop in Number 41 Village when the two accused along with Roy Pestano Jr drove up in a white car. An altercation took place and Davanand Ramlagan was injured and was left lying in a pool of blood.
The post mortem examination conducted by Government Pathologist, Dr Nehaul Singh, concluded that there were four wounds on the body, two stabbing and two slashing, while the throat was almost severed.
After the incident, Roy Pestano Sr. and his sons Raymond and Roy Pestano Jr. were arrested and charged with the capital offence.
They were tried earlier by Magistrate Kumar Doorsammy at the Weldaad Magistrate’s Court and the matter was discharged.
However, the men were ordered rearrested, and a new Preliminary Inquiry was held under Magistrate Roby Benn, but by them Roy Pestano Jr. had fled the jurisdiction.
They were committed to stand trial in December 2011.
They were first tried in the High Court in September 2013 and the jury had failed to reach a decision.
