The prosecution’s star witness in the Hogstye murder trial, in which a man and his son are facing the capital offence, yesterday completed his fourth day on the witness stand in the Berbice High Court.
The matter will continue today.
On trial are Krishna called ‘John’, 50, of Alness and Letter Kenny, Corentyne, Berbice, and his son Romel Krishna, 24, also of Alness. They are being tried before Justice Brassington Reynolds and a mixed jury for killing Shawn Fraser, between July 27 and 28th 2011, at Hogstye.
The men are being represented by attorneys Kim Kyte-John, who is representing Krishna, and Murseline Bacchus, who appears for Romel Krishna.
The state is being represented by Prosecutor Renita Singh.
After completing his evidence in chief which took almost two days, prosecution star witness Audwyn Bindah called ‘Audwyn Fraser’ who was also shot during the incident is being grilled by the two defence attorneys.
Bindah who was led in his evidence by Prosecutor Singh had given a detailed account of the events on that day. He stated how he and his brother left home to go to the backdam to tend to their rice field. They were confronted by the accused and subsequently shot. He saw the men shoot his brother. Although injured and being pursued by the men, Bindah had to flee for his life. He eventually ended up in the company of another brother.
Also testifying so far was Detective Assistant Superintendent of Police Gary Mc Allister, who stated that upon receiving certain information on the day in question he led a party of policemen into the backdam. They journeyed down the Saltan dam into the backlands before crossing over into Saltan Village, before reaching Hogstye dam, where they found the body of Shawn Fraser.
Detective Sergeant Gilbert Ross had testified that he and a party of policemen had journeyed to the backdam where they found the body of Fraser. Detective Corporal Andrew Ward also testified to the part he played during the investigation.
Police Corporal Harold Noble, who was in charge of the shift at the Whim Police Station, when the number one accused, Krishna called ‘John’, was taken in by his attorney, also took the stand.
Two sisters of the deceased have given evidence too – Raquel Fraser related to the court that she had identified the body of her brother during the post mortem examination. Kim Providence testified to the series of events that took place during the day, including the time the brothers left home to when she learnt of the incident. They were all grilled by Mr. Bacchus and Ms. Kyte-John.
In her opening address, State Prosecutor Singh had revealed that on the 27th of July, Shawn Fraser and his brother Audwyn Bindah called ‘Audwyn Fraser’ of 11 Adventure Farm, Corentyne, had left their home to attend to their rice field at the Hogstye back dam.
On their way they saw three men – Krishna called ‘John’, his son Romel Krishna, and one ‘Bobo’ – in the back dam.
The brothers had completed their work and were on their way out when they were attacked and shot by the three men.
Bindah was rushed to the Port Mourant Hospital and then the New Amsterdam Hospital. Shawn Fraser’s body was picked up and taken to the Port Mourant Hospital where he was pronounced dead.
A post Mortem examination was later conducted on the body of Shawn Fraser at the New Amsterdam hospital by Dr. Nehaul Singh. The cause of death was determined to be perforation of the lung due to penetrating wounds to the chest, compounded by a fractured skull.
