The Caribbean Court of Justice (CCJ), in one of two judgments yesterday, ordered that a local business pay the Guyana Oil Company (Guyoil) $97.6M for petroleum products supplied in September 2005.
Feizal Mohamed Amin,, trading under the name Amin Lumber Enterprise, had gone to the CCJ to challenged Guyoil which had gone to local courts here claiming $101M owed by the gas station owner.
In support of its claim, Guyoil presented to the trial judge a letter signed by Amin in which he admitted a debt to the company of $97.6M. The trial judge in Guyana held that the letter was not properly admitted into evidence and gave judgment for Amin on the basis that no debt had been established by the company.
The Court of Appeal, however, with regard to the letter, set aside the trial judge’s decision and gave judgment for the company in the full sum claimed. Amin appealed the judgment of the Court of Appeal, taking the matter to CCJ.
The CCJ yesterday concluded that the trial judge was wrong not to consider the letter but the Court disagreed with the Court of Appeal that there should be judgment in the full sum of $101,280,423.00 as distinct from $97,609,000.00, the amount admitted.
“The Court therefore allowed the appeal in part and gave judgment for the company in the sum of $97,609,000.00. The Court ordered costs against Mr Amin.”
Attorneys Rajendra Poonai and K. A. Juman-Yassin appeared for Amin while Hari ‘Ralph’ Ramkarran, SC, and Kamal Ramkarran appeared for Guyoil.
