Legal arguments continue to dominate the murder trial of the two Corentyne men accused of murdering another. A key prosecution witness was on the stand, yesterday.
On trial for the capital offence before Justice Diana Insanally and a mixed jury are Joshua Persaud, called ‘Sunny Boy’ and ‘Bun Boy’, 22, and Raphael Rene Morrison, called ‘Red Head’, 24, both of Bloomfield Corentyne, Berbice.
The two men are accused of murdering Marlon Andrew Ramcharran on June 3, last year along a street in Block C Tain New Housing area.
On Tuesday another legal argument erupted between the defence led by Attorney-at-law Mursalene Bacchus, and Prosecutor Attorney-at-law Pritina Singh.
On the witness stand was Prosecution star witness, Nicholas Beharry, who detailed what took place on the night of the murder.
He detailed how he and Rakesh Jaikarran, another friend, saw the two men chopping the deceased on the night in question. They had to run for their lives after calling out to the men who then chased them.
They hid until they taught it was safe before reporting about the incident. He is expected to return to the witness stand when the matter continues today.
So far the prosecution has called a number of witnesses include Detective Assistant Superintendent of police Gary Mc Alister who testified to visiting the scene and taking a statement from Morrison.
Detective Constable Emmanuel Rajnauth in his testimony gave evidence that he witness the statement given by Morrison. He also visited the scene of the crime and arrested Morrison and testified to finding the cutlass that as allegedly used to commit the crime.
Police Constable Nkofi Austin in his testimony stated that he arrested the number one accused, Joshua Persaud, at Black Bush Polder. Police Detective Constable Andel Doris testified to taking photographs of the scene. While two other witnesses also took the stand including the deceased father Surendra Ramcharan who identified the body.
Molchan Raghubir who testified that on the night in question the number one accused Persaud went by his house in company with Morrison and demanded a cutlass from him which he subsequently gave to him. The court had also visited the scene of the crime at Tain on the request of the defence.
Earlier Prosecutor Singh who presented the state’s case, said that on the day in question Ramcharran was at a bar in the village where he met two friends, Nicholas Beharry and Rakesh Jaikarran.
One of Nicholas friend’s borrowed his bicycle to go to ‘Dust Till Dawn’. The men subsequently went and look for the friend to retrieve the bicycle.
Around 02:30 hrs on the day in question, the friends left the bar. Marlon went ahead and his two friends followed behind. The friends subsequently heard Marlon pleading ‘you chopping the wrong person’.
Beharry and Rakesh then ran to where Marlon was shouting and there they saw the two accused chopping him. Marlon subsequently fell to the ground.
The judge has so far ruled that the statements given by the two accused are inadmissible.
