Lawyer for defendants in the Jagdeo/Kissoon libel case, Attorney Nigel Hughes yesterday presented a summons for the amendment of the defence’s case, along with a draft of the amendments being proposed.
Yesterday’s hearing at the High Court, before Judge Brassington Reynolds, was for discussions between the plaintiff and the defence over the issue that arose during the testimony of the defence’s latest witness. Lawyers for the plaintiff, Sase Gunraj and Senior Counsel Bernard De Santos (who was absent), requested additional time to formulate their affidavit in answer to Hughes’s amendments.
Gunraj explained that the plaintiff’s side had received the amendments late and was unable to complete its answer that is in the process of being finalized. The plaintiff’s side was initially given seven days to answer Hughes’s arguments. The court thus allowed the seven days to be fixed from the date the plaintiff had received Hughes’s amendments. The two sides are expected back in court on March 14.
Senior Counsel De Santos had difficulty with information being provided to the court by defence witness Lincoln Lewis, who was at the time giving evidence on the Critchlow Labour College and the alleged discriminatory act of removal of subventions by government, at the time led by former president Bharrat Jagdeo.
De Santos argued that there was no evidence to justify what the witness was saying. He argued that the defence lacked justification and carried no weight unless they can prove substantially the information being provided. De Santos is representing the former president who brought a lawsuit against Kaieteur News columnist Frederick Kissoon, Kaieteur News’ Editor-in-chief Adam Harris and Publisher Glenn Lall for more than $10million.
Hughes stated yesterday that he has amended the defence for all the defendants.
