A Partnership for National Unity (APNU) yesterday called on the government to further fortify the Judiciary.
This declaration was made during a press conference held at the office of the Leader of the Opposition on Hadfield Street, Georgetown.
During his presentation, parliamentarian and Shadow Minister of Legal Affairs Basil Williams asserted that while APNU welcomes the decision by President Donald Ramotar to increase the number of Puisne Judges to 20 in an effort to expedite trials and cut back on backlog of criminal and civil cases, it is also calling for other measures to be implemented.
The politician reminded media operatives that in June 2012, the coalition had passed a Motion calling on the National Assembly to ensure that the Judiciary receives its funding directly from the Consolidated Fund.
“Under the Fiscal Management and Accountability Act 2003, the Supreme Court is a budget agency under the Schedule of Estimates in the budget. By making it a budget agency, the government has made the Judiciary subordinate to the Legislature and the Executive. The Principal Act (Fiscal Management and Accountability – 2003) is contrary to the separation of powers and infringes on Articles 222 and 228 of the Constitution of Guyana.”
Williams then stressed that if President Donald Ramotar is serious about strengthening the Judiciary then he should do all that is necessary to ensure that the Fiscal Management and Accountability (Amendment) Bill 2012 and 2013; which were passed by a majority in the Parliament are re-tabled and assented.
He also called for the Constitutional Amendment Bill 2013 and the Former President’s Benefits (Amendments) Bill to also be re-tabled and given Presidential assent.
