…occupants ordered to vacate immediately
Proprietors of AIC Battery and Automotive Services Company Limited, Ingrid Campbell, and Alfred Chung, lost the final battle over a commercial property located at Vlissengen Road and Da Silva Street, Georgetown last Thursday following a High Court order.
The matter which had been running in the courts for close to 10 years came to a close when the couple was ordered by Justice Roxanne George to vacate the premises immediately. In addition, they were
ordered to pay $200,000 costs.
The case was initially called in 2003 in the High Court on the terms that the defendants, Campbell and Chung refused to vacate the premises after it was to be sold by a Receiver, Ramesh Lall, appointed by the National Bank of Industry and Commerce Limited (NBIC) – now Republic Bank (Guyana) Ltd – in order to settle a debt owed to the said bank.
After the ruling in favour of the Receiver, Campbell and Chung appealed to the Court of Appeal, and then to the Caribbean Court of Justice (CCJ) after the move to the Court of Appeal was dismissed.
During the final court hearing on Thursday, after the order was issued, the defendants’ lawyer, Neil Parsram, requested four days stay in the premises since his clients were intending to appeal the matter in the Court of Appeal.
The request was, however, denied by Justice George since she viewed the extension as an attempt to further prolong the court’s proceedings.
According to the Receiver’s lawyer, Mr. Andrew Pollard, the writ issuing the order for the couple to vacate the building was prepared and was to be executed on Monday morning.
When marshals arrived at the property, they found that the defendants had removed the day before (Sunday). Further, the keys to the property were not delivered. The marshals were therefore required to force their way into the premises after which possession was delivered to the Receiver.
When Kaieteur News spoke to Ingrid Campbell, the woman reiterated that she has been unjustly dealt with in the courts.
The woman said that she had been residing in the Da Silva Street building all her life and “as a result of the court system in Guyana which only favours the illegal and the rich, two senior citizens have nowhere to go.”
