Prosecution witness, Corporal Rawl Nedd, attached to the crime lab at Criminal
Investigations Department (CID) took the stand yesterday to present his evidence-in-chief in the Preliminary Inquiry (PI) into the death of 16 year-old Queen’s College student, Neesa Gopaul.
Chief Magistrate Priya Sewnarine-Beharry is conducting the pre-trial hearing against the girl’s mother, Bibi Gopaul, and Jarvis Small, the mother’s boyfriend.
The duo is accused of murdering the teen in late 2010. Following the discovery of a number of articles at the crime scene, the mother and her lover were arrested and later charged.
State Prosecutor, Pretima Kissoon, is prosecuting the matter and yesterday she led Nedd in the evidence.
Prior to Nedd taking the stand, two police witnesses who had returned for further cross- examination by the Defense had taken to the witness box to continue their evidence. However, the lawyers were not present in court yesterday.
Senior Counsel, Bernard De Santos, and Defence Lawyer, Vic Puran, who are representing Small and Gopaul respectively, had indicated, according to the court, that they would not have been available for the day. The accused, however, declined to cross-examine Detective Sergeant, Mitchell Caesar, and Assistant Superintendent of Police (ASP), Hugh Jessemy. The prosecution, too, declined to re-examine the witnesses.
Nedd subsequently gave his evidence as to his experience and qualification in his line of work. The Police Corporal spoke of the part he played into the investigation of the teen’s death.
Small, when given the opportunity, declined to cross-examine the Corporal while Gopaul attempted the task of her lawyer. She laid over a few questions to the witness in connection to what he had done at her home- the alleged crime scene.
The Prosecution also decline re-examination. The hearing revealed that the DNA specialist who is a vital part of the prosecution’s case is to return for the continuation of cross-examination by Puran.
In the meantime, the Prosecutor said that she has at least 10 more witnesses to take the stand. The PI will resume on Monday.
Neesa Gopaul was found tucked inside of a suitcase near Emerald Towers Resort, on the Soesdyke/Linden Highway on October 2, 2010. According to reports, part of the teen’s head was missing. Dumbbells had been wrapped around the suitcase in an effort to weigh the body down. Gopaul’s body was found by a family enjoying an outing at the creek.
