DEAR EDITOR,
There have been a number of articles which have been designed to influence the outcome of the complaint against Henry Greene. One lawyer even had the audacity to make reference to Lord Diplock. That lawyer had no understanding of the traditions and conventions of the society to which those of the ilk of Lord Diplock belong.
Lord Diplock would have expected Greene to do the honourable thing and resign.
In our system of justice in this country although there is a presumption of innocence, the virtual complainant has rights, and the best forum to make the determination of whether or not her complaint is credible would, in my opinion, and in the opinion of many Guyanese, be the High Court.
With respect to Greene holding the position of Top Cop, this is an absurdity.
Greene has passed the retirement age and neither former President Bharrat Jagdeo nor our current President Donald Ramotar has the authority to keep him as Commissioner.
The public has every right to call on President Ramotar to uphold the Constitution and instruct Greene to vacate the post of Commissioner as this is mandatory.
The fact that Laurie Lewis was kept as Commissioner for a period beyond his retirement age is no basis for ignoring the Constitution. That was a constitutional violation. Greene must and should vacate the office of Commissioner.
Since Greene has failed and/or refused to vacate the office of Commissioner which the Constitution requires him to do, President Ramotar should call on him to vacate the position.
Were the President to refuse to do what is mandatory, lawyers should file the appropriate motion to the High Court to ensure Greene’s removal.. Lawyers who unjustifiably feel that our judges here would be unwilling to force Greene to vacate the office could rest assured that Sir Dennis Byron and his team at the CCJ would uphold the constitution and bring to an end this outrage.
