A 20-year-old Jamaican man was yesterday ordered to pay a fine of $30,000 to the court or face six months’ imprisonment along with deportation back to his country.
The young man, who originally pleaded not guilty to the charge, changed his plea after learning that he would cause the matter to prolong. Bennett told the court that he was unaware of any date on the passport and did not know he was committing an offense.
The prosecuting officer, Lionel Harvey, stated that on March 6, last, Bennett entered the country and was given a six-month stay. The prosecutor added that there was no return date on the passport but there was a six-month period which the prosecutor claimed Bennett violated.
Representing Bennett, lawyer Mohamed Zafer, told the court that the accused was unaware of the matter and only learned of its severity when he went to get an extension for his stay at the immigration office at Anna Regina.
The lawyer said that the young man was staying with his sister at Lot 19 Windsor Castle, Essequibo and that the woman was unable to make an appearance at the hearing. The lawyer sought all means of getting the man released even telling the court that Bennett’s sister was prepared to buy the youngster a ticket to get home if it meant his release.
Magistrate Priya Sewnarine- Beharry advised the counsel that if Bennett pleaded guilty he would be in custody of the police where he would pay the fine and be deported, that if he chose otherwise the matter would be transferred to another court where the matter would continue.
To be rid of the matter and to avoid any more court appearances the young man chose a guilty plea. An application for deportation was made by the prosecution with a fine implemented by the Magistrate who also ruled in favour of the prosecution.
